The EEOC has statutory responsibility for enforcing Title I of the ADA , which prohibits discrimination against persons with disabilities by private sector employers and state and local governments with 15 or more employees. The ADA , which became effective on July 26, , states that employers must provide a reasonable accommodation to qualified employees with disabilities as long as it does not present an undue hardship in the operation of the employer's business.
The ADA defines a person with a disability as someone with a physical or mental impairment that substantially limits a major life activity, has a record of such an impairment, or is regarded as having such an impairment.
The Commission believes the language of the ADA , if left alone, could be too broadly defined. By explicitly defining the term "disability," the guidance will assist employers and employees in complying with and understanding the ADA , and assist EEOC investigators in enforcing the Act.
The guidance defines and explains the terms "impairment," "major life activities," and "substantially limits," which are important determinants of whether a person has a disability under the ADA. For purposes of paragraph 1 , major life activities include, but are not limited to, caring for oneself, performing manual tasks, seeing, hearing, eating, sleeping, walking, standing, lifting, bending, speaking, breathing, learning, reading, concentrating, thinking, communicating, and working.
For purposes of paragraph 1 , a major life activity also includes the operation of a major bodily function, including but not limited to, functions of the immune system, normal cell growth, digestive, bowel, bladder, neurological, brain, respiratory, circulatory, endocrine, and reproductive functions.
